THE 5300 BYLAWS ARTICLE XIII, PAGE 20 AND DEFINES RESPONSIBILITIES.
5300 M&M IS RESPONSIBLE FOR THE FOLLOWING:
Common elements are those areas, buildings, and facilities used regularly and in common by all unit owners of every condominium, such as grounds around swimming pools, pools, pool houses\ guest parking, roadways, fencing, security gates, common grounds, recreation hall, and courtesy bus. Maintenance and repair of elements are the responsibility of 5300 M&M Corporation and are not part of the general budget.
Any piping or wiring that carries fluids or electricity from more than one building is the responsibility of 5300 M&M to maintain and repair.
CORPORATION 5 IS RESPONSIBLE FOR THE FOLLOWING:
Limited common elements are those parts of a condominium building which constitute the walls, floors, ceilings, roofs, elevators, storage bins, general building structure, and the piping and wiring within those walls, floors, ceilings, windows, and general building structure, as well as assigned parking spaces. Further, limited common elements are generally those properties, equipment, and facilities used only by members of a particular condominium.
If that condominium association gives permission to 5300 M&M to perform maintenance and repairs to limited common elements, the association shall pay for the materials only to perform such repair or maintenance.
Drain lines, water lines, and wiring that carry fluids or electricity delivered to or from one particular building are the responsibility of that association until they reach the main trunk line. Any piping and wiring within the walls of the building are limited common elements and the responsibility of the association to maintain and repair.
UNIT OWNER IS RESPONSIBLE FOR THE FOLLOWING:
Maintenance and repairs to limited common elements are generally the responsibility of the condominium association; one exception is windows, which are the responsibility of the individual unit owner. Any wiring or piping within a unit, exposed outside the building's walls, belongs to the unit and is the unit owner's responsibility to maintain and repair. The unit owner may contract directly with 5300 M&M Corporation to maintain and do these repairs. These repairs shall be charged to and paid by the individual unit owner. Repairs not paid to 5300 M&M Corporation within the permitted time shall be collected by the association and be considered a special assessment against the unit.
